This computer program is protected by copyright law, program protection law, and international treaties. Unauthorized distribution or reproduction of this program, or any part of it may result in severe civil and criminal penalties, and will be procecuted to the maximum extent possible under the law.
REGARDLESS OF HOW YOU ACQUIRE THE PROGRAM (ELECTRONICALLY, PRE-LOADED, ON MEDIA OR OTHERWISE) DOWNLOADING, INSTALLING, PURCHASING OR USING THE PROGRAM SHALL INDICATE YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS CONTAINED IN THIS AGREEMENT AS WELL AS ANY TERMS AND CONDITIONS CONTAINED IN ANY OTHER LICENSE AGREEMENT THAT IS IDENTIFIED OR REFERENCED BELOW.
IF YOU ARE INSTALLING BRAINA YOURSELF, AS AN ADDITIONAL CONFIRMATION OF ACCEPTANCE OR REJECTION OF THIS LICENSE AGREEMENT, YOU ARE REQUIRED DURING THE INSTALLATION SETUP TO READ THIS LICENSE AGREEMENT AND ACCEPT ALL OF THE TERMS OF THIS AGREEMENT AND THE TERMS AND CONDITIONS OF ANY OTHER LICENSE AGREEMENT THAT ARE IDENTIFIED OR REFERENCED BELOW AS A PART OF THIS LICENSE AGREEMENT.
IF DUE TO UNFORSEEN CONDITIONS THE SOFTWARE INSTALLS WHEN YOU DO NOT AGREE WITH THIS LICENSE AGREEMENT, YOU MUST UNINSTALL THE SOFTWARE TO AVOID BREAKING THE TERMS AND CONDITIONS OF THIS AGREEMENT. INADVERTANT INSTALLATION OF BRAINA DOES NOT NEGATE OR CANCEL THE TERMS OF THIS AGREEMENT.
THIS SOFTWARE IS DESIGNED FOR INDIVIDUALS OVER THE AGE OF THIRTEEN. BY ACCEPTING THE TERMS OF THE LICENSE AGREEMENT YOU STATE THAT YOU ARE THIRTEEN YEARS OF AGE OR OLDER. DO NOT INSTALL THIS SOFTWARE IF YOU UNDER THE AGE OF THIRTEEN, OR IF THE SOFTWARE IS ALREADY INSTALLED, IMMEDIATELY UNINSTALL, OR DO NOT USE THIS SOFTWARE.
SOFTWARE LICENSE AGREEMENT AND LIMITED WARRANTY
If you don't agree with the terms, privacy policy or any disclaimers below, you should not use or evaluate this Software.
In this agreement:
"Software" means the Brainasoft product(s) you have obtained for evaluation or purchased, including the programs, documentation, and other materials;
"We" or "us" means Brainasoft, a company based in Ahmedabad, Gujarat, India;
"You" means the evaluator or end user of the Software;
"Services" means any services, features or functions that Brainasoft may provide you.
This non-exclusive legal agreement allows you to use the Software under the terms and conditions below:
>> This software is only to be used for NON-COMMERCIAL purpose (i.e. for your own personal use) unless you have paid a fee and purchased a commercial usage license from us.
>> You may not distribute this software by any means. If you wish to distribute this software you must get a written consent from Brainasoft.
>> You must not use, copy, modify, transmit, adapt, vary or create derivative works based on the Software in whole or part. You may make reasonable copies of documentation for help, reference and back-up purposes.
>> Any use that is not explicitly authorized by law, reverse engineering, decompiling, and disassembling are prohibited.
>> We own the Software under copyright, trade secret and all other laws that may apply. The software, its structure and algorithms, are protected by copyright, database and other
intellectual property laws, and all intellectual property rights in them belong to Brainasoft unless noted otherwise. All Brainasoft's product names, designs, and logos are trademarks of Brainasoft.
>> You must not rent, lease, sub-license, sell or otherwise transfer the software to any third party or allow it (or the Documentation) to be accesses by or copied onto another person's computer.
>> You must not use any other software system to read, search, interpret or access the data in the software provided by us.
>> Any Serial keys you receive in order to personalize, install, upgrade or register the software are private and confidential information known only to you and to us, and should not be given to others under any circumstances. If you do, your purchased license to use the Software is automatically revoked and terminated, you must remove the Software from your computer(s), and you may be liable for legal damages.
>> You will effect and maintain adequate security measures to safeguard the software from theft or from access by any person other than those permitted in this License.
>> You may not use the software or services in any way that may adversely affect Brainasoft's services or the ability of other users to use those services in any way.
>> All purchases are final and non-refundable.
>> Our software may include advertising for other products.
>> We may occasionally send you email with recommendations or notices of new products, prices, and services. Separately, we may send service notifications via email to keep you informed about the status of Braina and to provide updates and technical notices. We follow strict best practices for email marketing and customer contact. You can any time unsubscribe from receiving such emails from us.
>> LIMITED WARRANTY: We don't promise that the Software will be free of software bugs or program errors. If you report an error or bug to us, we will address it as part of our normal maintenance procedures but we don't guarantee that the bug will be removed. If we issue a maintenance release for the Software containing a correction for an error you reported, we will make a copy of that release available to you for electronic download at no charge.
>> PRIVACY POLICY:
Your privacy is important to Brainasoft. This privacy statement provides information about the personal information that we collect and the ways in which your personal information is used or can be used.
We collect information from you when you subscribe to our newsletter, respond to a survey or fill out a form.
When ordering or registering on our site or via other products, as appropriate, you may be asked to enter your name, gender, birthdate, location details, e-mail address etc.
We may collect information about your system on which Braina runs such as your operating system name and version.
We do not use the information we collect from you to identify you as an individual. We use this information for research and development purposes and to improve your experience with the services. We do collect personal information to improve the Services as described below. We implement a variety of security measures to maintain the safety of your information.
Any of the information we collect from you may be used in one of the following ways:
- To improve customer service
(Your information helps us more effectively respond to the customer service requests and support needs)
- To send periodic emails
(We may use your email address to ask for feedback or inform you of product news and opportunities. We also provide a method to opt out of such future communications.)

(Your information helps us to better respond to your individual needs)

(E.g., when you ask Braina to find a good restaurant or advise you on the weather, Braina needs to know where you are at the moment)
- To provide, maintain, protect, and improve our services and develop new ones
(Your feedbacks always inspire us to improve our services)
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing. We may also release your information when we believe release is appropriate to comply with the law, enforce our website policies, or protect ours or others rights, property, or safety. However, non-personally identifiable user information may be provided to other parties for marketing, advertising, or other uses. Information collected by the third-party applications provider is governed by their privacy policies.
>> By using Braina, you grant Brainasoft the right without compensation to use your comments relating to the Platform and Service in connection with testimonials, quotes, for publication, and to use your / business name and business logo in Company’s client list and marketing materials.
>> In order to deliver the Services to you, Braina invokes a number of third-party applications which were not developed by Brainasoft, i.e. browser, email and SMS programs, and other applications. We cannot take responsibility for any functionality, content, suitability, privacy, support or other attribute of those applications or the content they may request from or deliver to you. Your use of those applications, including when you access them via Braina, is governed by any license agreements you may have entered into with their respective vendors.
>> We cannot guarantee that web searches or other queries you submit via software to other applications will not result in displaying content or links to content that you may find objectionable, offensive, or otherwise inappropriate. Such content is not within our control.
>> Terms of Purchase: If you subscribe to any services that we offer for a charge, you will pay the applicable fees as they become due plus all related taxes and reimburse us for any collection costs and interest for any overdue amounts.
>> You may use the Services only for lawful purposes. You are responsible for compliance with all federal, state, and local law applicable to your use of the services.
>> Third Party services: Occasionally, at our discretion, we may include or offer third party products or services through our website and other services. Braina uses third-party voice recognition systems in its services. Depending on the accent and speech peculiarities those third-party voice recognition systems might misunderstand or misrecognize what people say. It is your responsibility to verify that the results obtained from those third-party voice recognition systems are accurate. Brainasoft shall assume no liability whatsoever with respect to availability or the failure of those third-party voice recognition systems to correctly recognize any spoken utterances. These third party sites and services have
separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites or services.
>> Fees, Costs, and Other Expenses:
The Services make use of a data network operated by the device manufacturer and/or your wireless service provider to send data from your device to our servers, and to serve information back to you. Depending on your data plan, you may incur charges from the device manufacturer or your wireless service provider for use of their networks and/or for specific services.
You are solely responsible for any and all costs you incur as a result of your usage of the Services.

This product uses services provided by World Weather Online for providing weather information.

- DISCLAIMER: This software is provided "as-is" and without warranty of any kind whatsoever, including any implied warranties of merchantability or fitness for a particular purpose. You assume full responsibility for the selection and use of the software to achieve your intended results, and acknowledge that if you use the software improperly you can cause damage to your files, software and data. We do not undertake any responsibility for any damage or data loss caused by the use of this program. You agree that you use the software at your own discretion and risk, and that you are solely responsible for any and all harm and damages incurred through using the Services.
- HIGH RISK ACTIVITIES. The software is not fault-tolerant and is not designed, manufactured or intended for use as online control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, or any other environment in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities"). We specifically disclaim any express or implied warranty of fitness for high risk activities for the software or any portion thereof.
- You acknowledge and agree that the Services are neither intended nor suitable for urgent emergency use, and that you will not use it for emergency purposes.
- LIMITATION OF LIABILITY: In no event shall we be liable for any incidental, consequential, or punitive damages whatsoever arising out of use of the program or your relationship with us.
>> Changes to our Terms and Conditions:
Brainasoft reserves the right to modify these Terms and Conditions at any time, without notice, for any reason. Please review the current version of these Terms and Conditions from time to time at www.brainasoft.com/braina/terms.html to keep up to date on any changes.
